Terms & Conditions of Sale

1. Orders and Contract Formation

Submission of an order through the Site constitutes an offer to purchase the selected Products. A binding contract is formed only upon Vittori’s confirmation of the order by email. Vittori reserves the right, prior to shipment, to decline any order where Products are unavailable, where pricing or description errors exist, or where there is suspicion of fraud, abuse, or other improper activity.

2. Pricing and Payment

All prices are shown in United States Dollars unless otherwise indicated. Taxes, shipping, and handling charges are calculated and displayed at checkout. Payment in full is required at the time of order, and only the methods indicated on the Site are accepted. Orders not successfully authorized may be cancelled.

3. Title and Risk

Title to the Products shall pass to you upon Vittori’s receipt of full payment of the purchase price. Risk of loss or damage to the Products shall transfer to you upon Vittori’s delivery of the Products to the carrier for shipment, regardless of whether shipping costs are prepaid by Vittori or charged to you. From that point, the Products are at your risk, and Vittori shall not be liable for any loss, theft, or damage occurring during transit or thereafter.

4. Shipping and Delivery

Any delivery times indicated are estimates only and not guaranteed. Vittori shall not be liable for delays caused by carriers, customs authorities, or events beyond its reasonable control. Delivery is complete when the Products are delivered to the address you provide at checkout.

5. Returns and Refunds

All sales of Exclusive Merchandise, including limited edition, numbered, capsule, and customized Products, are final and may not be cancelled, returned, or refunded.

Standard Merchandise may, subject to Vittori’s sole approval, be eligible for return within fourteen (14) calendar days of delivery, provided that the Products are unused, unworn, and undamaged, with all original packaging, tags, and seals intact, and accompanied by proof of purchase and a return authorization issued by Vittori. Any item that, in Vittori’s assessment, does not comply with these conditions shall not be eligible for return or refund. Refunds, when approved, will be made to the original form of payment within thirty (30) days of receipt of the returned Products.

6. Damaged or Defective Products

You must notify Vittori within seven (7)days of delivery if the Products are received damaged or defective, providing supporting evidence. At its discretion, Vittori may repair or replace the Product or issue a refund.

7. Restrictions on Resale Damaged or Defective Products

Products purchased on the Site are intended solely for personal use. Any unauthorized resale, distribution, or commercial use constitutes a material breach of these Terms and may result in cancellation of orders, refusal of future sales, and pursuit of legal remedies available under applicable law, including claims for damages and injunctive relief.

8. Intellectual Property

All trademarks, trade names, logos, product designs, photographs, graphics, text, and other materials displayed on the Site (collectively, the “Intellectual Property”) are the exclusive property of Vittori or its licensors and are protected under applicable copyright, trademark, and intellectual property laws worldwide.

Use of the Site or purchase of Products does not confer any license, right, or interest in the Intellectual Property. You may access the Site and its content solely for personal, non-commercial purposes in connection with your purchase of Products.

Any unauthorized reproduction, distribution, modification, display, or use of the Intellectual Property, including but not limited to counterfeit production, resale under false association, or exploitation for commercial purposes, is strictly prohibited and may subject you to civil and criminal penalties under applicable law. Vittori reserves the right to enforce its intellectual property rights to the fullest extent permitted by law.

9. Warranty Disclaimer

All Products are provided “as is” and “as available.” Vittori disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by law, Vittori shall not be liable for indirect, incidental, special, or consequential damages arising out of or related to your purchase or use of the Products. Vittori’s aggregate liability shall not exceed the purchase price actually paid for the Product in question. Certain state laws do not allow limitations on implied warranties or the exclusion of incidental damages; in such jurisdictions, these limitations shall apply only to the extent permitted.

11. Force Majeure

Vittori shall not be responsible for failure or delay in performance due to causes beyond its reasonable control, including acts of God, strikes, shortages of materials, transportation delays, acts of terrorism, pandemics, or governmental restrictions.

12. Export Compliance

Products may be subject to United States export control laws. You agree not to purchase or ship Products in violation of U.S. export laws or to any country or person prohibited under applicable sanctions.

13. Privacy

Personal data provided in connection with an order will be processed in accordance with Vittori’s Privacy Policy.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. You consent to the exclusive jurisdiction of the state and federal courts located in Delaware for resolution of disputes arising out of or related to these Terms.

15. Miscellaneous

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect. No failure or delay in exercising any right shall constitute a waiver thereof. You may not assign your rights under these Terms without prior written consent from Vittori. Vittori may assign its rights without restriction. These Terms constitute the entire agreement between you and Vittori regarding purchases from the Site.
